Cap-exempt H-1B petitions are not subject to the annual 65,000 + 20,000 (U.S. master's) numerical caps or the March lottery. Created by the American Competitiveness in the Twenty-First Century Act (AC21) in 2000, this pathway allows qualifying employers - accredited higher-education institutions, university-affiliated or -related nonprofits, government research organizations, and nonprofit research organizations - to file H-1B petitions any time of year with start dates tied to approval, not the October 1 cap-season date. Under the new FY2027 wage-weighted lottery, cap-exempt roles are even more attractive to workers whose salaries don't rank in the top wage levels.
