Overview

Understanding this pathway

There isn't one "founder visa" - there are four practical routes, each fitting a different profile. O-1A works well pre-revenue if you have press, judging roles, accelerator acceptance, and a critical role at a funded company. E-2 requires treaty-country citizenship and a substantial, active investment. L-1A requires an existing foreign entity where you worked as a manager or executive for at least one year. The International Entrepreneur Rule (IEP) is a DHS parole (not a visa) for founders who meet specific funding thresholds and don't yet clear the O-1 / E-2 / L-1 bars - up to 5 years total, but no dual intent and no direct green card path.

Who it's for

Founders and executives with traction, funding, unique expertise, or treaty-country citizenship - anyone building a company they want to scale in the U.S.

Why it exists

The U.S. immigration system doesn't have a single startup visa, so Congress and DHS have built multiple discretionary and treaty-based pathways to attract job-creating entrepreneurs.

In practice

A merit-based route built for real careers, not lotteries.

Key benefits

Why founders and specialists choose it

01

Multiple entry points

Match the visa to your stage and profile, not the other way around.

02

Retain ownership

All four routes let you build and run your own company.

03

Family included

Spouse and children accompany you; L-2 and E-2 spouses get work authorization.

04

Green card ladders

O-1A → EB-1A / EB-2 NIW; L-1A → EB-1C.

05

No lottery

None of these pathways runs through the H-1B lottery.

06

IEP fallback

Up to 5 years of parole for founders meeting funding thresholds.

FAQ

Frequently asked

Usually O-1A. It evaluates your personal achievements - press, judging, awards, critical role, accelerator selection - not company financials.
